We have designed hundreds of consumer research studies across a wide range of industries. Our goal is to obtain high-quality information from a representative sample of the targeted population, and we have strict procedures in place to minimize potential biases in data collection. Survey samples are obtained from prominent marketing research companies that maintain multi-million member online consumer panels.
Trademark Surveys
Consumer research studies are commonly employed to prove likelihood of confusion, secondary meaning, strength of mark, acquired distinctiveness, consumer perception, dilution, and other Lanham Act claims in the context of trademark and trade-dress litigation.
Our state-of-the art survey designs are probative of the relevant issues in each case, target specific consumer populations with appropriate universe selection and sampling frames, and feature cutting-edge rotation and randomization of hundreds of question types with customizable complex skip and display logic when appropriate.
We have developed surveys for firms across the nation that manage some of the largest trademark portfolios in the world, including Fox Rothschild LLP in New Jersey and Philadelphia, LeClairRyan in Los Angeles, Day Pitney LLP in New York City, Hogan Lovells in Washington, DC, and Riemer & Braunstein LLP in Boston.
Our litigation surveys have been accepted as evidence in matters involving a broad range of products and services. Principals Mark Keegan and Anthony Donato also have extensive testimony experience.
Marketing Surveys
Surveys are also an invaluable tool for brands who want to gauge consumer perception of products or services; assess the buying habits of a target market; test the marketplace for a new brand name, logo or concept; and other key marketing issues.
Studies by Keegan & Donato Consulting examine issues such as the extent to which particular marketing claims influence consumer demand for a product, how marketing communications impact consumer likelihood of purchase, and the relationship between marketing communications and the consumer’s willingness to pay a premium for a product.
We recently designed and executed a two-pronged market research study to gauge both consumer awareness and consumer perception of a client’s brand. This client organizes and promotes social painting events that are primarily targeted to a female audience and was interested to see how its brand compared to competitors in their market.
Qualified respondents were screened to ensure that they were females of U.S. legal drinking age (21 or older) and had recently attended a social painting event or were likely to do so in the near future. The sampling was also restricted to the geographic markets in which the client operates. Respondents were randomly assigned to two groups – a consumer awareness module and a consumer perception module.
The results showed that the client is the most recognized social painting brand in its geographic area, that the brand is perceived as “more fun” than its competitors, and that its marketing efforts have been effective. The empirical evidence we collected provided exceptional value to our client in terms of continuing to successfully market its brand.
